Appeals

The Clinton Law Firm has handled many appeals for clients. If you lose your case, it may be worthwhile to appeal the decision. Most decisions of the trial courts are affirmed, but a significant percentage of cases are reversed. The losing party usually has 30 days to appeal an adverse file decision.

Ed Clinton, Jr. was a law clerk for the Honorable Michael S. Kanne of the Seventh Circuit from September 1991 to September 1992. Ed has written many appellate briefs and argued before the Illinois Appellate Court and the Seventh Circuit Court of Appeals. Ed Clinton, Sr. also has significant experience with appeals. Ed has also prepared petitions for leave to appeal to the Illinois Supreme Court and petitions for certiorari to the United States Supreme Court.

Julia Williams has written numerous appellate briefs and has argued twice before the Seventh Circuit.

Most appeals can be handled on a flat fee basis. That means that the client pays a flat fee for the entire appeal. The client is also responsible for paying any filing fees that are due and paying for the preparation of the record on appeal. We generally do not handle appeals on a contingent basis. McAndrew v. Cantwell , 15-0126 IL App 1st Dist. 2015. (handled appeal involving the propriety of an attorney’s possessory lien under Illinois law)

Baugh Dalton v. Brown , 2016 Ill. App. 1st 152603-U (handled appeal of jury verdict in legal fee cases)

Swift v. Medicate Pharmacy , 2016 Ill. App 1st 152786-U (handled appeal of dismissal of complaint alleging that a dissociated partner of a partnership had the right to seek an accounting).

First American Bank v. Goodson , 16-1122 (7th Cir. 2017) (handled appeal of Bank’s claim against attorney where attorney inadvertently endorsed a bad check – argued successfully that the attorney was not liable under the UCC or common law)

Dobbs v. Dupuy Orthopaedics , No. 16-2135 (7th Cir. 2017) (handled appeal of legal fee award – and argued successfully that the district court failed to consider all relevant factors)

Jaskula v. Dybka , 2017 IL App (1st) 160014-U (handled appeal of disqualification issue)

Shutack v. Sidley Austin, LLP , 2017 IL App (1st) 160747-U (handled appeal of legal malpractice case challenging Illinois’ 6 month statute of limitations for legal malpractice claims arising out of the death of the client)

Hudson v. Tibble , 2018 IL App (1st) 162469 (successfully handled appeal of an Estate where the attorney for the administrator of the Estate argued that he had no duty to the Estate)
